Community vs. Separate Property
- Community property (marital property) — property that is owned by both spouses, although it may be held in the sole name of only one of the spouses. This includes any property that is acquired during the marriage with a few exceptions: gifts given specifically to one spouse, inheritances made specifically to one spouse, or property willed specifically to one spouse.
- Separate property — property that is acquired before the date of marriage, or which is received as a gift or inheritance. Separate property is not subject to division in divorce.
